In a ruling in the first quarter of this year the Ombudsman says yes on digital distribution of documents to individual owners.
The basis of this was a dispute between a property manager and some owners of the Shelanu complex. The owners had requested to have the financial information sent to them digitally so that they could check where the money was spent.
The Sectional Titles Act clearly states that every owner has the right, upon request, to get insight in any document related to the finances and management of their Sectional Title. To comply to the property manager had invited the owners to visit their office and get insight on paper. The owners did not agree with this practice. They decided to ask the Ombudsman ‘s oppinion on the matter.
Ironically, the property manager used an electronic system to manage the property and on a regular basis sent out the reports by email to the trustees.
